Sex Offender Wins Legal Battle Over Prison Pen Pal Scheme

A sex offender has successfully challenged the abolition of a prison pen pal scheme after it was dismantled due to safety concerns. The inmate, whose identity remains confidential to protect his victims, was sentenced in 2015 for multiple sexual offenses against three teenage girls. He had been utilizing the Prisoner Correspondence Network, a program facilitating communication between inmates and individuals outside prison, since 2019.

The situation escalated when the inmate was transferred to Rolleston Prison near Christchurch in 2023. The prison’s director decided to discontinue the pen pal scheme following an incident in which another inmate, also a sex offender, attempted to contact a child related to one of the inmate’s pen pals. The director was particularly concerned about the potential for prisoners to reach out to minors or their guardians, given that a previous incident had already occurred.

Following the termination of the service, the inmate lodged formal complaints, including one to the Office of the Inspectorate. He argued that the pen pal program was crucial for building a support network that would aid his reintegration into society upon release. In response, he initiated a civil case against the Rolleston prison manager, which was heard in the High Court in Christchurch last month.

Under New Zealand law, prison managers have the authority to restrict correspondence for various reasons, including communications with minors or materials that may facilitate criminal activity. The prison manager admitted that the decision to eliminate the pen pal service lacked a lawful basis and that there were no substantial grounds for its removal.

Justice Lisa Preston ruled in favor of the inmate, ordering the reinstatement of the pen pal program. Additionally, the court directed that he be compensated $1,275 for legal costs incurred during the proceedings.

Leigh Marsh, the Commissioner of Custodial Services for the Department of Corrections, acknowledged the potential for misuse of the internal mail system by inmates. He noted that prisoners often exploit these channels to threaten victims, manipulate individuals for money or contraband, and initiate inappropriate relationships. While the internal mail is monitored, decisions on withholding correspondence are made on a case-by-case basis.

Marsh confirmed that the blanket ban on the Prisoner Correspondence Network’s mail at Rolleston Prison was lifted in mid-September 2023. The service will now be managed similarly to all other mail at the facility, with ongoing monitoring to detect any inappropriate or illegal content.

A spokesperson for the Prisoner Correspondence Network Aotearoa criticized the initial ban, asserting it constituted a form of collective punishment. “The ban destroyed many long-term pro-social connections between existing pen pals and prevented people incarcerated at Rolleston from accessing the proven therapeutic benefits of our pen pal service,” the spokesperson stated.

The network emphasized its commitment to ensuring the safety of both pen pal volunteers and inmates, expressing disappointment that a judicial review was needed to resolve the matter. They highlighted their proactive approach in addressing safety concerns over the past year, although efforts were hampered by administrative changes and volunteer fatigue.

The resolution of this case underscores the delicate balance between maintaining safety within correctional facilities and ensuring that inmates have access to rehabilitative resources that can aid their reintegration into society.
