Navigating Pension Options: Australian Citizen’s Dilemma in NZ
An Australian citizen living in New Zealand is seeking clarity on her pension entitlements as she approaches retirement age. The individual, who has resided in New Zealand since 1996 and worked primarily as a secondary school teacher, has raised questions about her eligibility for both New Zealand Superannuation and the Australian age pension.
The inquiry, addressed through the new RNZ podcast “No Stupid Questions” hosted by Susan Edmunds, highlights the complexities faced by expatriates navigating retirement benefits across borders. As she turns 65, the individual anticipates receiving NZ Super. However, she is uncertain about transitioning to the Australian pension at 67 and whether her New Zealand benefits would continue if she returned to Australia.
New Zealand and Australia have a reciprocal Social Security Agreement (SSA), which applies in such situations. Harry Fenton, the International, Disability and Generations Policy General Manager, explained that NZ Super is structured to ensure fairness for those who live or work overseas.
“Under the SSA, Australian citizens moving to New Zealand, who meet the necessary criteria, can access benefits on the same terms as New Zealand citizens,” Fenton noted. For eligibility, applicants must meet residency requirements, and time spent in Australia can also be counted.
An Australian citizen can qualify for NZ Super at age 65, provided they meet all conditions, including the requisite years of residence in New Zealand. If they rely on their time in Australia to fulfill residency criteria, they must wait until age 67.
Fenton advised that individuals in this situation should consult the Ministry of Social Development (MSD) service center for personalized guidance to avoid unexpected outcomes. He also emphasized that the Australian age pension comes with income and asset testing.
In a different scenario, an individual has raised concerns regarding the delayed repayment of a retirement village investment after the departure of a resident. Following the death of her father in 2013, the inheritance included a retirement unit with a clause allowing a stepmother to stay until her departure in March 2023. As of October, no refurbishment has commenced, and the unit remains unsold.
The Retirement Commission responded to this issue, noting that operators of retirement villages are not required to repay capital until the unit is sold. They are obligated to actively market the property and provide regular updates to the owner. If these responsibilities are not met, a formal complaint can be lodged.
To initiate a complaint, the owner must submit a written request to the operator, who is mandated to respond within 20 working days. If the unit remains unsold for nine months, the owner may issue a dispute notice.
Additionally, the Retirement Villages Act 2003 is under review, with potential changes aimed at facilitating earlier capital repayments. Stakeholders expect cabinet decisions later this year, focusing on improving the process for residents leaving villages.
