Tenants Ordered to Pay $30,000 After Abandoning Rental Property
In a recent ruling, a Tenancy Tribunal has ordered five tenants to pay their landlord over $30,000 after they abandoned a four-bedroom home in New Zealand, leaving behind significant damage and rubbish. The group had initially signed a 12-month fixed-term tenancy but vacated the property only months later, citing high rent as their primary issue.
Details of the Abandonment
The tenants, identified as Toni Jamie Whakaara, Hoana Violet Whakaara, Xavier Tausili, Violet Whakaara, and James Francis Whakaara, were renting the property for $980 per week. Upon leaving, they took the keys and parts of a garage door but left behind various items, including tyres, a bicycle, furniture, and clothing. The property was also found to have extensive damage, including issues with 11 internal walls, three internal doors, and broken glass in the back door.
According to the adjudicator, Mike Edison, the total amount owed by the tenants covers unpaid rent and the costs associated with repairing the property. Although the Tribunal has ordered the payment, it has postponed its decision on whether the tenants will be responsible for any further rent payments.
Implications of the Ruling
This case highlights the serious financial implications of abandoning rental agreements. Landlords often face significant costs related to repairs and lost income when tenants vacate properties prematurely. The ruling serves as a reminder to tenants about their responsibilities under tenancy agreements and the potential legal consequences of breaching them.
The Tribunal’s decision reflects a commitment to uphold the rights of landlords while ensuring that tenants understand the obligations of their contracts. As the case progresses, it may set a precedent for similar disputes in the future, emphasizing the importance of clear communication between landlords and tenants regarding expectations and responsibilities.
