Driver Discharged After Fatal New Year’s Day Crash
A New Zealand court has discharged Jasmine May Donaldson without conviction following a car crash that resulted in the death of her friend, Jade Nicole Richards, on January 1, 2023. The incident occurred as the two women were returning from the Rhythm and Vines music festival in Gisborne, which they attended over the New Year holiday.
According to the court, Donaldson was driving home with Richards and another friend when the vehicle veered out of its lane on State Highway 30, approximately 20 kilometers northeast of Rotorua. The car struck a rock wall, flipped, and ultimately came to rest on its roof. While Donaldson and the front-seat passenger managed to escape the vehicle, Richards, who had been asleep in the back seat, tragically died at the scene.
During the sentencing, Judge Gregory Hikaka emphasized the importance of accountability, stating, “The word ‘sorry’ would have gone a long way.” This remark highlighted the emotional weight of the incident and the impact on those involved, especially the victim’s family.
The court heard that the crash was not caused by excessive speed or reckless behavior; rather, it was attributed to a lapse in attention. Despite this, the loss of life remains a significant tragedy, with Richards’ family expressing their deep sorrow over the loss.
As part of the court proceedings, Donaldson’s legal team argued for leniency, citing her lack of previous convictions and the devastating consequences of the accident. The judge ultimately decided on a discharge without conviction, reflecting both the circumstances of the crash and Donaldson’s personal history.
