Court Declines to Register Child Sex Offender Despite Charges
A recent ruling from the Hamilton District Court has raised concerns regarding the management of child sex offenders. On September 5, 2025, Judge Philip Crayton opted not to place David Brian Moynaham on the Child Sex Offender Register, despite serious charges of possessing child exploitation material.
Moynaham faced charges related to the possession of objectionable publications, specifically involving 4,691 images of children, which included disturbing depictions of young minors engaged in sexual acts. The evidence presented showed that Moynaham had access to a total of twelve electronic devices, amplifying the severity of the situation.
Raewyn Greenhalgh, the Crown prosecutor, argued vehemently that Moynaham represented a significant risk to the community. Despite these arguments and the overwhelming nature of the evidence, Judge Crayton determined that registration was not warranted.
The court’s decision has sparked outrage among child protection advocates and raised questions about the effectiveness of current laws regarding child sex offenders. The Child Sex Offender Register is designed to monitor individuals deemed a threat to society, and critics argue that failing to register Moynaham undermines public safety.
