US Nuclear Safety Rules Altered to Expedite AI Power Generation

The US Department of Energy (DoE) has revised nuclear safety regulations to expedite the construction of new nuclear reactors, which are essential for powering artificial intelligence (AI) applications. According to a report by NPR, these changes aim to facilitate the launch of three experimental commercial nuclear reactors by July 4, 2024. The report highlights significant alterations to nuclear safety and security standards that have not been publicly disclosed, aimed at promoting the development of small modular reactors (SMRs).

The revised regulations come as private equity, venture capital, and public investments, reportedly amounting to billions, support this initiative. Major technology companies, including Amazon, Google, and Meta, are backing this project, indicating a desire for affordable and reliable energy sources for their AI infrastructures.

Changes to Safety and Environmental Regulations

NPR’s investigation reveals that the updated rules significantly dilute existing safety measures. For instance, protections for groundwater have been downgraded; companies are now only required to “consider” minimizing radioactive contamination rather than being mandated to protect groundwater. The previously stringent requirement to implement the “best available technology” for safeguarding water supplies has also been eliminated.

Environmental protections have similarly been weakened. The new guidelines propose merely “minimizing” environmental impacts “if practical,” rather than enforcing rigorous protection measures. This shift raises concerns about the potential adverse effects on ecosystems from radiation and radioactive materials released during operations.

In terms of security, the revisions have drastically reduced the volume of required documentation. Where over 500 pages of security rules once existed, they have now been condensed to a mere 23-page order, with many critical areas summarized into bullet points. Furthermore, standards for radioactive waste management have been significantly truncated, with omissions regarding waste packaging and monitoring.

One of the more notable changes involves accident investigation thresholds, which have been raised from incidents exposing workers to twice the legal dose of radioactive material to four times that limit. The DoE justifies these revisions by claiming that reducing regulatory burdens will foster innovation without compromising safety. Nevertheless, NPR notes that the removal of longstanding principles, such as the concept of “As Low As Reasonably Achievable” (ALARA) regarding radiation exposure, could lead to increased risks for workers and the environment.

Sanchit Vir Gogia, chief analyst at Greyhound Research, emphasized that the relaxation of foundational nuclear safety protocols represents more than just a regulatory shift; it redefines how infrastructure risk will be managed in the future. He pointed out that enterprise leaders considering SMRs must be aware that these reactors may now operate under less transparent internal directives that lack independent auditing and public scrutiny.

Brian Jackson, principal research director at Info-Tech Research Group, expressed concern for tech giants involved in funding these nuclear projects. He noted that while the direct risk of a radioactive incident may be low, the reputational risks associated with potential failures could have significant consequences for companies like Google, Meta, and Amazon. The growing public scrutiny of data center expansions for AI, coupled with environmental concerns, adds to the pressure these companies face.

Matt Kimball, vice president and principal analyst at Moor Insights & Strategy, raised questions about the transparency of the regulatory changes. Although he acknowledged that some adjustments may be necessary for the deployment of SMRs, he cautioned against the perception of rewriting rules behind closed doors, which can lead to public distrust.

Despite the potential environmental advantages of SMRs—such as reduced water usage and minimized contamination risks—Kimball stressed the need for responsible and ethical deployment of nuclear power. He stated that while SMRs are designed to mitigate many environmental impacts, the efficacy of the new regulations remains uncertain.

Gogia further highlighted that the risks associated with these regulatory changes extend beyond radiation leaks. The lack of thorough documentation and investigation of system anomalies could undermine operational stability and incident response protocols, potentially affecting disaster recovery efforts.

The shift from independent oversight by the Nuclear Regulatory Commission (NRC) to internal authorization by the DoE creates a fundamental misalignment between enterprise risk management and reactor safety governance. As Gogia succinctly put it, “the referee now plays for the home team,” indicating a potential conflict of interest that could jeopardize safety and accountability in the nuclear sector.
