Lower Hutt Mayor Condemns Assault on 10-Year-Old at Park
The violent sexual assault of a 10-year-old boy at Avalon Park in Lower Hutt has sparked outrage and condemnation from local authorities. Mayor Ken Laban expressed his deep concern over the incident, stating that such acts “have no place in our community.” This tragic event unfolded on December 28, 2022, when the alleged assailant followed the boy into the park’s public toilets, where he threatened him with a cold object and subsequently assaulted him, according to court documents.
The offender, who was under the care of Oranga Tamariki at the time, was not under a detention order, which limited the agency’s ability to prevent the incident. This has raised significant concerns, leading Children’s Commissioner Claire Achmad to address the case with Oranga Tamariki. Mayor Laban extended his thoughts to the victim and his family, emphasizing the need for community collaboration to ensure the safety and wellbeing of all residents, particularly children.
Authorities Respond to the Assault
In the wake of the assault, a spokesperson for Hutt City Council disclosed that police utilized CCTV footage during the investigation, which has since prompted an increase in surveillance coverage at the park. This enhancement is part of the development of the new Motutawa Skatepark facility aimed at improving safety in the area.
In March 2023, the defendant was deemed unfit to stand trial under the Criminal Procedure (Mentally Impaired Persons) Act following assessments from two mental health professionals. The legal proceedings took a significant turn in May when Judge Jan Kelly ordered that the defendant be detained in a secure facility under the Intellectual Disability (Compulsory Care and Rehabilitation) Act 2003 for a period of three years. The legislation allows for the possibility of extending this detention if the individual continues to pose a risk at the end of the initial term.
