Mayor Condemns Violent Assault of 10-Year-Old in Local Park
The violent sexual assault of a 10-year-old boy at Avalon Park in the Hutt Valley has sparked outrage and concern among community leaders. The incident occurred on December 28, 2022, when the alleged assailant followed the victim into the park’s public toilets. According to court documents, the attacker threatened the boy with a cold object at his neck before robbing, sexually assaulting, and raping him.
Lower Hutt Mayor Ken Laban expressed his deep distress over the incident, stating it “has no place in our community.” He emphasized the need for collective action to ensure the safety and well-being of residents, particularly the young. Laban extended his thoughts to the victim and his family, urging the community to work together to prevent such traumatic events in the future.
The alleged perpetrator, who was in the care of Oranga Tamariki at the time of the attack, was not under a detention order, limiting the agency’s ability to physically detain him. This situation has raised serious concerns, prompting Dr. Claire Achmad, the Children’s Commissioner, to address the matter with Oranga Tamariki.
In the aftermath of the assault, police utilized CCTV footage to aid their investigation. Following the incident, the Hutt City Council increased surveillance in Avalon Park as part of the new Motutawa Skatepark facility, enhancing safety measures for the public.
In March 2023, the defendant was deemed unfit to stand trial under the Criminal Procedure (Mentally Impaired Persons) Act, based on findings from two mental health evaluations. Despite being classified with a high to very high risk of reoffending, Judge Jan Kelly ordered in May that he be detained in a secure facility under the Intellectual Disability (Compulsory Care and Rehabilitation) Act 2003 for a period of three years. This arrangement allows for the possibility of continued detention if the individual continues to pose a risk.
Authorities stress the importance of community support for those affected by sexual violence.
